I too suffer from this and something lets me shoot to my full upload throughput (5 MiB/s) for a few minutes before throttling me down to a mere 1.5 for the rest of the connection duration. I was not able to find a reasonable solution. Connections through SSL are fluctuating a bit but are generally higher between 2 and 3.5 for me. Maybe try it out. Complain, write, make a big fuzz and send a nasty letter to the NetAgency (if a 100 000 customers do this it will stop !). In the meantime tinker around, see if other protocols on your router achieve better results, Otherwise go online with router+vpn plus eddie from your comp ... You could also replace your cable router modem and see if it helps to disguise your traffic. At mydealz.de you may find a bargain router (hint: not advertising anything). Of course it could depend on your more or less exact location. As you are a Unitymedia customer, I suspect it's western Germany for you and northern for me (Kabel DE). Also, I live downtown.
